Kommissionens motivering Inte bara flygsäkerhet utan även främja sysselsättning och tillväxt, utveckla den inre marknaden och stärka Europas roll som global aktör. Bidra till en konkurrenskraftig europeisk luftfartsindustri generera högt kvalificerade jobb bidra till teknisk innovation skapa ett effektivt regelverk för integrering av nya affärsmodeller och ny teknik.

Kommissionens motivering, forts. I detta initiativ föreslås bl.a. att en unionsram skapas för säker integrering av obemannade luftfartyg i det europeiska luftrummet.

Obemannade tjänster… Tillverkningen av obemannade luftfartyg har en gränsöverskridande dimension Inom obemannade luftfartygstjänster håller många på att utveckla gränsöverskridande verksamhet. T.ex. vid inspektioner av infrastruktur vill operatörerna ha möjlighet att använda samma obemannade luftfartyg och tillämpa samma operativa krav med samma pilot på olika platser i unionen för att utveckla sin verksamhet. Subsidiaritetsprincipen dock är tillämplig på genomförandet av gemensamma operativa bestämmelser; Medlemsstaterna kan göra lokala riskbedömningar och besluta om vilket luftrum som ska vara öppet eller stängt för flygningar med obemannade luftfartyg, och på vilka villkor.

Konsekvensbedömningar… Den nuvarande uppdelningen mellan unionen och MS, ett tröskelvärde på 150 kg, anses allmänt vara föråldrad. Reglerna bör utvecklas mot ett verksamhetscentrerat tillvägagångssätt, där riskerna bedöms för varje driftform Säkerhets- och privatlivsrelaterade aspekter av obemannade luftfartyg (security & integritet): inget behov av nya regler, däremot bättre tillämpning av befintliga regler, med ett närmare samarbete mellan nationella luftfartsmyndigheter och nationella dataskyddsmyndigheter.

Article 45 – Essential Requirements for Unmanned Aircraft The design, production, maintenance and operation of unmanned aircraft and their engines, propellers, parts, non-installed equipment and equipment to control them remotely shall comply with the essential requirements set out in Annex IX. - “Väsentliga” krav ges i bilaga IX: Section VII Unmanned aircraft   Article 45 Essential Requirements for Unmanned Aircraft The design, production, maintenance and operation of unmanned aircraft and their engines, propellers, parts, non-installed equipment and equipment to control them remotely shall comply with the essential requirements set out in Annex IX. Article 46 Compliance of Unmanned Aircraft 1. Where the delegated acts adopted pursuant to Article 47 so provide with a view to achieving adequate levels of safety, having regard to the principles laid down in Article 4(2), the design, production, maintenance and operation of unmanned aircraft shall be subject to certification. Certificates shall be issued upon application, where the applicant has demonstrated that it complies with the rules established by the delegated acts adopted pursuant to Article 47 to ensure compliance with the essential requirements referred to in Article 45. The certificate shall specify the safety-related limitations, operating conditions and privileges. 2. Where the delegated acts adopted pursuant to Article 47 so provide with a view to achieving adequate levels of safety, having regard to the principles laid down in Article 4(2), the design, production, maintenance and operation of unmanned aircraft shall be subject to a declaration. The declaration shall be made when the essential requirements referred to in Article 45 and the corresponding detailed rules established in accordance with Article 47 to ensure compliance with these essential requirements are complied with. 3. Where the delegated acts adopted pursuant to Article 47 so provide, given that adequate levels of safety can be achieved without the application of Chapters IV and V of this Regulation, those Chapters shall not apply to the essential requirements referred to in Article 45 and the corresponding detailed rules established in accordance with Article 47 to ensure compliance with these essential requirements. In such cases, those requirements and rules shall constitute 'Community harmonisation legislation' within the meaning of Regulation (EC) 765/2008 of the European Parliament and Council of 9 July 2008 setting out the requirement for accreditation and market surveillance relating to the marketing of products and repealing Regulation (EEC) N° 339/93, and Decision 768/2008/EC of the European Parliament and Council of 9 July 2008 on a common framework for the marketing of products, and repealing Council Decision 93/465/EEC. Article 47 Delegated Powers 1. For the design, production, maintenance and operation of unmanned aircraft and their engines, propellers, parts, non-installed equipment and equipment to control the aircraft remotely, the Commission shall be empowered to adopt delegated acts in accordance with Article 117 in order to lay down detailed rules with regard to: the conditions and procedures for issuing, maintaining, amending, suspending, or revoking the certificates for the design, production, maintenance and operation of unmanned aircraft referred to in Article 46 (1) and (2), including the conditions for situations in which, with a view to achieving the objectives set out in Article 1 and while taking account of the nature and risk of the particular activity concerned, such certificates shall be required or declarations shall be permitted, as applicable; the conditions and procedures under which an operator of an unmanned aircraft shall rely on the certificates or declarations issued in accordance with Sections I, II, III and VIII; the conditions under which the requirements concerning the design, production and maintenance of unmanned aircraft and their engines, propellers, parts, non-installed equipment and equipment to control them remotely, shall not be subject to Chapters IV and V of this Regulation, for the purpose of Article 46(3); the privileges and responsibilities of the holders of certificates and operators making declarations; the marking and identification of unmanned aircraft; the conditions under which operations of unmanned aircraft shall be prohibited, limited or subject to certain conditions in the interest of safety. 2. As regards the design, production, maintenance and operation of unmanned aircraft and their engines, propellers, parts, non-installed equipment and equipment to control the aircraft remotely, the Commission shall be empowered, by means of delegated acts adopted in accordance with Article 117, to amend or supplement Annex IX and, if applicable, Annex III, where necessary for reasons of technical, operational or scientific developments or safety evidence related to air operations, in order and to the extent required to achieve the objectives laid down in Article 1. Article 4(2): The measures taken under this Regulation shall correspond and be proportionate to the nature and risk of each particular activity to which they relate. In preparing and enacting such measures, the Member States, the Commission and the Agency shall take into account, as appropriate for the activity concerned: whether persons other than flight crew are carried on board, and in particular whether the operation is open to members of the public; to what extent third parties or property on the ground could be endangered by the activity; the complexity and performance of the aircraft involved; the purpose of the flight and type of airspace used; the type, scale, and complexity of the operation or activity, including, where relevant, the size and type of the traffic handled by the responsible organisation or person; the extent to which the persons affected by the risks involved in the operation are able to assess and exercise control over those risks; the results of past certification and oversight activities.

Essential requirements for the design, production, maintenance and operation of unmanned aircraft (a) A person operating the unmanned aircraft must be aware of the applicable Union and national rules relating to the intended operations, in particular with regard to safety, privacy, data protection, liability, insurance, security or environmental protection. The person must be able to ensure the safety of operation and safe separation of the unmanned aircraft from people on the ground and from other airspace users. This includes being familiar with the operating instructions provided by the manufacturer and with all relevant functionalities of the unmanned aircraft and applicable rules of the air and ATM/ANS procedures. (b) An unmanned aircraft must be designed and constructed so that it is fitted for its function, and can be operated, adjusted and maintained without putting persons at risk when these operations are carried out under the conditions for which the aircraft was designed. (c) If necessary to mitigate risks pertaining to safety, privacy, protection of personal data, security or the environment, arising from the operation, the unmanned aircraft must have the corresponding and specific features and functionalities which take into account the principles of privacy and protection of personal data by design and by default. According to the needs those features and functionalities must ensure easy identification of the aircraft and of the nature and purpose of the operation; and must ensure that applicable limitations, prohibitions or conditions be complied with, notably with respect to the operation in particular geographical zones, beyond certain distances from the operator or at certain altitudes. Article 46 – Compliance of Unmanned Aircraft Vem ska ge tillstånd, vem ska bedriva tillsyn? Kopplat till om en viss driftform är farlig. De metoder som ges står i proportion till risk: Branschstandard Deklaration? Certifiering befintliga mekanismer för övervakning av marknaden Ensidig deklaration, ansvar läggs på operatör NAA till viss del ”Traditionell” certifiering (EASA) EASA och NAA I artikel 46 beskrivs de olika sätten att visa att de grundläggande kraven är uppfyllda. Eftersom obemannade luftfartyg kan utföra verksamheter som inte varit möjliga med bemannade luftfartyg finns det en lång rad risker som är förknippade med flygningar med obemannade luftfartyg – alltifrån traditionell användning med hög risk, som liknar risker i samband med bemannade flygningar, till mycket låg risk. För att bibehålla regler och förfaranden på en nivå som står i proportion till riskerna med verksamheten är det nödvändigt att övergå till ett verksamhetscentrerat tillvägagångssätt där man bedömer den exakta risken med en verksamhet eller typ av verksamheter. För massproducerade obemannade luftfartyg som utgör en låg risk föreslås att man använder befintliga mekanismer för övervakning av marknaden, reglerade genom förordning 765/2008 och beslut 768/2008, som är specifikt utformade för tillverkning och saluföring av en sådan typ av produkter. Även i detta fall förblir dock luftfartsmyndigheter indirekt involverade, eftersom de begränsningar av den operativa kapaciteten som skulle införas (t.ex. att det obemannade luftfartyget inte får flyga högre än t.ex. 50 m för att begränsa riskerna) måste härröra direkt från traditionella luftfartskrav. Samtidigt som byrån inte skulle ansvara för tillsynen av marknadsövervakningsmekanismerna har kommissionen alltid rätt att kontrollera om medlemsstaterna fullgör sina skyldigheter. Dessutom bygger marknadsövervakningsmekanismen på välgrundade klagomål från medborgare eller företag för att upptäcka produkter som inte uppfyller kraven. Konstaterade fall av bristande efterlevnad i en viss medlemsstat meddelas därefter genom hela den gemensamma marknaden.
